The Divine Mathematics

Inheritance (Mirath) is unique in Islam because the shares are fixed by Allah in the Quran (Surah Nisa), not decided by a will.

  • Fixed Sharers (Ashab al-Furud): These heirs get a specific fraction (e.g., Wife 1/8, Mother 1/6) first.
  • Residuaries (Asaba): Usually male relatives (Sons, Father) who take the remainder after fixed shares are paid.
  • Blocking (Hjab): Some heirs block others. For example, a Son blocks the deceased's Brothers/Sisters from inheriting.

Steps Before Distribution

1. Funeral Costs

Paid from estate first (modest, no extravagance).

2. Debts

Unpaid loans, Mahr owed to wife, or Zakat/Kaffarah owed to Allah.

3. Bequests (Wasiyyah)

Up to 1/3rd can be given to charity/non-heirs.

4. Distribution

The remainder is divided among heirs.

Why does the son get double the daughter?

In Islamic law, financial responsibility rests entirely on men. A woman's inheritance is hers alone to keep, while a man must spend his on the family, wife, and children. Thus, the larger share corresponds to larger liability.

Can I give more to a specific child?

No. The Prophet (pbuh) forbade making a bequest (Wasiyyah) to an heir who already has a fixed share in the Quran, as this causes family disputes. You can, however, give gifts (Hibah) during your lifetime, provided you treat all children equally.

What comes before Inheritance?

Before distributing shares, you must: 1. Pay funeral expenses. 2. Pay off all debts (to people and Allah). 3. Fulfill any valid bequests (Wasiyyah) to non-heirs (up to 1/3rd of estate).
